Pakistan Patent Requirements
  Patent in Pakistan: In order to apply and file for a patent in Pakistan you need to provide 1. Patent Information, and you need to send to the Attorney the 2. Power of Attorney for Pakistan and the 3. Assignment Document if required.
 

1.- Filing information – Pakistan Patent

For Direct or Convention Applications

  • Patent Application Order Form: Client has to complete and send back to us the Patent Application Order Form (attached).
  • Copy of the specification of invention including claims and drawings
  • English translation (Specifications and Priority document). To be presented with the filing. They must be verified and notarized.
  • Declaration of Inventor in favor of the applicant, if applicant is different than the inventor.
  • Certified Priority Document with application number and country of origin. The certified priority document has to be presented within 3 months.
  • Various application forms Power of Authority (Form P-28), 2) Form P-2 and Form P-2A.

Please note that Pakistan is not a contracting country of PCT; therefore, an applicant in Pakistan cannot claim priority on the basis of PCT application.

The application must be accepted within 18 or 21 months by latest. After acceptance, it is advertised in the Official Gazette for opposition and if there is no opposition within four months from the date of publication of the acceptance, the application is sealed on payment of the sealing fee.

Annuities:

Renewal fee is due annually, beginning with the 5th year of the patent term.

  2. Preliminary Exam
  3. Patent Publication: 18 months from the priority date
  4. Formal Examination Request: Before 36 months from the filing date. Must be requested after 60 days from the patent publication date.
  5. 90 days to respond office action from the formal examination.
  6. Acceptance or rejection
  7. Payment of the Final Taxes and Title.
