Taiwan Patent Requirements
  Patent in Taiwan: In order to apply and file for a patent in Taiwan you need to provide 1. Patent Information, and you need to send to the Attorney the 2. Power of Attorney for Taiwan and the 3. Assignment Document if required.
 

1.- Filing information – Taiwan Patent

  • Our filled out patent order form.
  • Copy of the specification of invention including claims and drawings.
  • Chinese translation (Specifications and Priority document).
  • Certified priority document, including priority number and country of origin.
  • Deed of Assignment.

Note:

Please Note that Taiwan is not a member of the Paris Convention.
It is possible to claim a foreign priority within 12 months from its filing date, as long as the prior application is filed in a member of WTO (World Trade Organization).
Regarding PCT international applications, it is possible to claim its priority within 12 months from the application date.

Annuities:

There is no maintenance fee before a patent application is allowed through substantive examination. The first year annuity should be paid together with the patent certificate fee to obtain the patent certificate. The due date for effecting the 2nd and subsequent annuity payments of a patent is one day before the publication date of each payment year.

For the first Annuity, as the base date should be the date of receiving the approval decision

Concession of the Patent Grant: 20 years

Concession of the Utility Model or Design Application: 15 years

  1. Patent Filing
  2. Preliminary Exam
  3. Patent Publication: 18 months from the priority date
  4. Formal Examination Request: Before 36 months from the filing date. Must be requested after 60 days from the patent publication date.
  5. 90 days to respond office action from the formal examination.
  6. Acceptance or rejection
  7. Payment of the Final Taxes and Title.
