Filling timelines

The time limit for the PCT national phase entry in Indonesia is 31 months from the earliest date of priority and 12 months for Direct Paris Route application. These terms can be restored by paying the regarding fees and providing the required documents.

The time limit for filing a design is 6 months from the earliest date of priority. This time limit ca be restored within 3 months from the missed term.

Examination stage

The request for examination must be filed within 3 years from the earliest priority date. It is possible to request accelerated examination under PPH or ASEAN agreement.

In Indonesia, the process for design applications starts with a formal examination. Following this initial step, the application is made public for a period of three months, during which oppositions can be filed. Should there be any oppositions, a substantive examination is carried out, taking place within six months after the end of the opposition period. This examination phase is contingent upon whether any opposition has been filed against the application.

Granting

The granting fee must be paid within 1 month from the notice of allowance. For PCT applications the patent will be valid for 20 years from the international filing date, and 20 years from the filing date for Paris route direct filings.

How long can it take an Indonesian patent to be issued?

A standard patent application process in Indonesia can take between 2 and 4 years from the filing date. However, a PPH requested can be filed to potentially allow the applicant to reduce the examination time in more than a half. Contact us for additional information.

Can an Indonesian patent application be restored after abandonment?

Yes, a patent application that has been abandoned, it can be revived by filing a request for restoration, submitting evidence of the reason for missing the deadline and pays a surcharge.
