Filling Timelines

The time limit for the PCT national phase entry in Europe is 30 months from the earliest date of priority and a patent application claiming conventional priority should be filed within 12 months from the priority date. If this time period expires, only under exceptional circumstances, priority may be restored for 2 additional months.

It takes six months from the priority date to file an Italian industrial design application claiming conventional priority. This term may be restored, only under exceptional circumstances, for two additional months.

Italian patent application in Italian, signed POA, inventor declaration, assignment, and a copy of the Priority Document (if applicable).

Examination

No examination request must be paid. The Italian patent application claiming priority undergoes examination by The European Patent Office, which performs a prior art search, and issues a Search Report and a Written Opinion.

The Italian Patent Office examines to verify formal requirements of the Italian design application and other relevant requirements. Note that no examination of the novelty and individual character is conducted.

Granting

An Italian patent is valid for 20 years from the filing date, and annuities must be paid starting from the 5th year.

The industrial design patent in Italy is valid for 5 years from the date of filing and may be renewed for up to a total term of 25 years from the date of filing.
