Filling Timelines

The time limit for the PCT national phase entry is 30 months from the earliest date of priority for national phases and 12 months for local patent applications. It is possible to restore this term within two months after this period provided duly ground application is filed.

The time limit for filing a design is 6 months from the earliest date of priority. This term may be restored within 2 months after the expiration of this deadline.

Examination

Examination is conducted automatically once the application has been filed. In Portugal it is possible to request an accelerated examination under the PPH (Patent Prosecution Highway).

A design application in Portugal undergoes a formal examination only.

Maintenance

Maintenance fees must be paid as from the 3rd year from the PCT international filing
date. Applicant may receive maintenance fees reminders; however, it is the responsibility of the patentee to ensure renewal fees are paid timely to prevent expiration of the patent.

After the registration is granted, a Certificate is available during the lifetime of the design by paying the respective official fees. Renewal fees are due every 5 years from the filing date up to the design patent validity term of 25 years.
