Filling timelines
The time limit for the PCT national phase entry in is 30 months from the earliest date of
priority and 12 months for direct patent applications (Paris route). This time limit can be extended for 2 additional months paying an additional fee.
The time limit for filing a design is 6 months from the earliest date of priority.

Examination stage
The request for examination must be filed within 3 years from the international filing date (if applicable) or the earliest priority date. The first examination report is normally issued between 12 and 18 months from the date of the examination request.
No examination fees must be requested during the pendency of the application. However, after the registration you must request a valuation report in order to enforce your rights. Please check the granting section below.
Granting
The registration fees should be paid within 2 months from the receipt of the notice of allowance along with the pending annuities at the time of the acceptance.
Once your design is accepted for registration the applicant must proceed with the payment of the registration fees within 2 months from the granting notice. It is important to mention that in China the registration does not enforce the right of your design, the exclusive use of the patented design is not protected until a positive evaluation report of the patent is issued. The purpose of this report is to put the patented design into a search and substantive examination, the report will disclose whether the patent right is stable. Contact us for additional information.
A standard patent application process in China can take around 2 years from the filing date if the request for examination is filed in earlier stage. Yes, a patent application that has been abandoned during examination, can be revived by filing a request for restoration and paying the regardign fee within 2 months from the abandonment notice.
