Filling Timelines
The time limit for the PCT national phase entry is 30 months from the earliest date of priority for national phases and 12 months for local patent applications and restoration of this term is not possible.
The time limit for filing a design is 6 months from the earliest date of priority. Term is not
extendable.

Examination
Patent applications in Spain must be filed along with a request for prior art search. Additionally, the application will undergo formal and substantive examinations. The request for substantive examination should be submitted within three months from the publication of the report on prior art search.
The application is checked as to compliance with the formal requirements. A substantive
examination is not stipulated for industrial design applications in Spain.
Maintenance
Annual fees are due each year starting from the third one. Annuities for the years which
have expired or begun on the date of patent grant should be paid within three months
from the publication of grant.
An industrial design patent in Spain is valid for 5 years from the date of filing, and can be
renewed for 5-year periods, up to a maximum term of 25 years. Renewal should be requested before the expiration of the current 5-year term.
