Filling Timelines

The time limit for claiming priority is 12 months for local patent applications. Restoration of this term is possible within 2 months. It is important to mention that PCT national phase is not possible, must be requested through the European patent.

The term for filing an industrial design application in France claiming conventional priority is 6 months from the priority date. The restoration of this term is possible.

Examination

The search fee must be paid upon filing or within a time limit of 1 month from the filing date. The search results are in the form of a “preliminary search report” with written opinion, having the same structure as a European or PCT search report. In France it is possible to request an accelerated examination under the PPH (Patent Prosecution
Highway).

Applications for an industrial design registration are examined as to the compliance with formal requirements.

Granting

When the final search report is drawn up, the Applicant is invited to pay the grant and printing fees.

Initial term of an industrial design registration is 5 years from the filing date, extendable 4 times up to 25 years.
