Patent Requirements in Thailand
  In order for applying and filing for a patent in Thailand you need to provide the Patent Information and send us the Deed of Assignment if required.
 

Thai Patent Application Requirements

 

  1. Name and address of the applicant. If it is a Company, place of incorporation.
  2. Name, address and citizenship of the Inventor(s)/Designer(s).
  3. Invention Title, Abstract of the Invention or Design.
  4. Invention specifications / description.
  5. Claims.
  6. Set of formal drawings if applicable.
  7. Thai translation of the specification is required.
  8. Inventors Declaration which does not need to be notarized.
  9. Certified priority document, including priority number and country of origin, should be submitted within 90 days.
  10. Deed of Assignment if applicant different than inventor.
  11. Power of Attorney must be notarized by notary public and filed within 90 days.


 

Patents in Thailand

 

A Thai Patent is effective for a term of: 20 years (from the filing date)

Design patents are effective for a term of: 10 years

Approximate Patent Application processing time: 5 years.

Member of the Paris Convention: No

Member of the PCT: No

Member Countries from the World Trade Organization have 1 year priority.

Thailand Patent and Trademark Office: Department of Intellectual Property (DIP)

 

  1. Patent Filing
  2. Preliminary Examination
  3. Publication
  4. Request for Substantive Examination (must be requested within 5 years from the date of publication)
  5. Acceptance (Notice of Allowance) or rejection.
  6. Registration Fees.
  7. Payment of the annuities starts the 5th year.
