Filling timelines

The time limit for the PCT national phase entry in UK is 31 months from the earliest date of priority and 12 months for Direct Paris Route application. This term can be restored within two months from the missed deadline.

The time limit for filing a design is 6 months from the earliest date of priority. Also has a novelty grace period of 12 months before the filing date or priority date.

Examination stage

The request for substantive examination, must be filed within six months from the publication of the patent application for Direct Paris Route applications and within 33 months from the date of priority for National phases.

The patent office will review if the design application meets all formalities and registrability. No examination fees must be paid. If the application is accepted to registration, the design will be published in the Community Designs Bulletin and a certificate of registration will be issued. Normally the granted patent is issued within 3 months from the filing date.

No official granting fee must be paid, however it is very common for UK patent attorneys to charge the reporting and forwarding the Grant Decision.

How long can it take a UK patent to be issued?

A standard patent application process in UK can take between 2 and 5 years from the filing date for invention patents. Note also a PPH can be filed in order to accelerate the examination. On the other hand, design patents are granted within a year.

Can a UK patent application be restored after abandonment?

Yes, a patent application that has been abandoned, can be restored. You must apply for the restoration request within 19 months of the date the patent ceased.
